Mini Session Booking Contract
    C O N T R A C T
    I understand that a full photo session requires a booking deposit of $100.00, which is applied to the total balance. This deposit is neither refundable nor transferable if session is cancelled by client. Client no show at time of shoot will be invoiced for balance. Deposit payments can be made via PayPal or Venmo. Session balance can be cash, card or Venmo, Mini session payments are due in full within 24 hours of booking and are nonrefundable and non transferable. 

    Images will be delivered 7-10 days after the date of the session. During busy season (September-December) it may take as long as 14 days. Images are delivered via Pixieset. USB drives are extra and are available for purchase. Images will be deleted from online gallery 30 days after they have been released to you. After your 30 days your images will be added to an external hard drive and if client ever needs images pulled from archives a $25 additional fee will occur per session pulled.

    The content of the gallery is in discretion of burkard photography. Burkard photography will hand pick about 30-60 photos from your session for your galley. Session include a set amount of digital images (see pricing page for details) client may purchase additional digital images, at $25 an image or the full galleries may be purchased.

    Burkard photography is not responsible for lack of images, due to clients lack of participation and cooperation. Only usable images will be edited and added to clients gallery. Client will not have the right to see unedited photos and can not request unedited photos.

    Burkard Photography will retain the full copyright on all images (including digital files). Client is prohibited from further editing of images. 
    This includes black and white filters, or any filters from applications. Client may not, for any reason sell their images to any third party. Burkard Photography has permission to use images of my and or my family including minors on websites, blogs and all marketing and/or advertising materials. 

    I understand if I choose to print my pictures somewhere other than through Burkard Photography, the quality and or colors may not be the same as seen in online gallery.

    Client understands that Photographer works to maintain a safe work environment, including but not limited to, complying with applicable governmental laws, directives, orders, and regulations (each a “Governmental Order”). Client further understands and agrees that Photographer shall not be required to perform under this Agreement if the Event is held in violation of a Governmental Order or Photographer’s participation in the Event would violate a Governmental Order. Client also understands and agrees that Photographer is not obligated to continue to perform under this Agreement if Photographer’s personal safety or well-being has been or will be comprised or threatened at the Event, including, but not limited to, as a result of the condition of the venue for the Event, or the conduct of an attendee of the Event. ​
     
    R E F U N D S
    If your digital images are damaged or lost prior to viewing your gallery for any reason by the photographer, your session fee will be refunded in full. No refunds will be given for dissatisfaction with your images. Print products may not be returned for any reason other than damage or error on the part of the photographer at time of delivery. If your product is damaged on the part of the photographer, it will be exchanged and re-ordered for the same product, undamaged. If your product includes error by the photographer, your product will be exchanged and re-ordered for the same product, error free. There are no refunds or exchanges on any digital products. No refund will be given due to lack of subject cooperation.

    T A R D I N E S S 
    Tardiness on the client's part will result in reduced shooting time, which may result in less images presented by the photographer. 

    F A M I L Y  M E M B E R S  O R  N O N  P A R T I C I P A N T S  
    Photographer has the right to ask any non photo participant to leave photo area during a session if they are being distracting or in photographers way. Cell phone photos are not allowed during session.

    C A N C E L L A T I O N
    If client requests to reschedule, cancel the session date, or fails to show-up at a scheduled session this will result in the session balance being invoiced.
     
    I have read and understood the session package information as shown on Burkard Photography's website, the services to be provided, and I agree to the terms as stated.
